1,("Customer"), acknowledge and agree that my participation in remote HVAC consultation services provided by FixWithAPro LLC ("Company"), including via video, phone, or online communication ("Session"), involves inherent risks.
I understand that HVAC systems involve electrical, mechanical, and environmental hazards that may result in personal injury, property damage, or death. I voluntarily choose to participate and assume all associated risks.
1. Scope of Services:

• I understand and agree that:

• The Company provides remote advisory guidance only.

• The Company does not perform any physical inspection, repair, installation, or on-site services.

•  All physical actions taken during or after the Session are performed solely by me. 

• The Session is for general informational and educational purposes only and does not constitute professional HVAC repair, inspection, installation, or licensed contracting services.

•  The Company will not provide guidance involving refrigerant handling, gas-related adjustments, major electrical work, bypassing safety devices, or any activity requiring a licensed contractor under applicable law.

•  The Session is limited to basic residential HVAC diagnostics and guidance and does not include advanced or regulated work.

• The Company may refuse or stop guidance at any time if a situation is deemed unsafe or beyond appropriate scope.

• The Company makes no representation that the Session satisfies licensing or regulatory requirements in any jurisdiction outside Ohio.

2. Acknowledgement of Risks:

I acknowledge that working on HVAC systems may involve risks including, but not limited to:

• Electrical shock.

• Exposure to moving mechanical parts.

• Fire hazards.

• Property damage.

• Personal injury or death.

I understand these risks cannot be eliminated. I will immediately stop any activity if I feel uncomfortable, unsafe, or unsure, and may request to end the session at any time.
3.    Assumption of Responsibility:

I agree that:

• I am solely responsible for any actions I take based on the Session.

• I will only perform tasks that I feel comfortable and capable of completing safely.

• I will immediately stop if I feel unsafe or uncertain at any time.

• I will seek assistance from a licensed HVAC professional if the issue exceeds my ability or comfort level.

• I retain full control over all decisions and actions taken during or after the Session and am  solely responsible for deciding whether to perform any task.

4.    No Contractor Relationship:

I understand that FixWithAPro LLC is not acting as a licensed HVAC contractor performing regulated work. This service does not replace in-person professional services where required by law.
5.    Waiver and Release of Liability:

I understand and acknowledge that HVAC systems and related troubleshooting may involve inherent and potentially dangerous conditions, including but not limited to electrical hazards, gas leaks, combustion hazards, refrigerant exposure, moving mechanical parts, fire hazards, water damage, mold exposure, structural hazards, equipment failure, personal injury, or death. I voluntarily choose to participate in the Session and knowingly assume all risks, known or unknown, associated with any actions taken during or after the Session. To the fullest extent permitted by law, I release, waive, and discharge FixWithAPro LLC and its owners, members, managers, employees, contractors, agents, successors, and assigns from any and all claims, liabilities, damages, losses, or causes of action arising out of or related to the Session, including any actions I take based on information or guidance provided during the Session. I further knowingly and voluntarily waive any claim arising from ordinary negligence by the Company to the fullest extent permitted by law. Company disclaims all warranties, express or implied, including any implied warranties of fitness for a particular purpose or any warranty regarding diagnosis accuracy, repair success, system performance, or professional outcome. To the fullest extent permitted by law, Company's total aggregate liability arising out of or related to the Session shall not exceed the total amount paid by Customer for the Session. Any claim arising out of or related to the Session or services provided must be brought within one (l) year from the date of the Session.
6.    Indemnification:

I agree to defend, indemnify, and hold harmless FixWithAPro LLC and its owners, members, managers, employees, contractors, agents, successors, and assigns from and against any and all claims, demands, liabilities, damages, losses, fines, penalties, costs, and expenses, including reasonable attorneys' fees, arising out of or related to my participation in the Session, any work or actions performed by me, misuse of tools or equipment, injury to any person, property damage, violation of any law, code, regulation, lease, warranty, insurance requirement, or manufacturer instruction, or failure to follow instructions or safety precautions. This indemnification obligation survives termination of the Agreement and Session. 
7.    No Guarantee of Outcome:

I understand that the Company makes no guarantees regarding:
Diagnosis accuracy.
Repair success.
System performance or longevity.
All guidance is based on information available during the Session. The Company has no duty to identify all defects, hazards, code violations, or unsafe conditions.
8.    Acknowledgment of Understanding:

I have read and fully understand this Waiver. I acknowledge that I am signing it voluntarily and that no oral statements or representations have been made that modify its terms. Electronic signatures and electronically transmitted copies of this Waiver shall be treated as originals and legally binding.
